3. Use of the Website and Purchase of Goods

  • Product Information and Availability:

    • We strive to ensure that all details, descriptions, images, and prices of Goods appearing on the Website are accurate. However, errors (including processing errors) may occur. If we discover an error in the price or description of any Goods which You have ordered, we will inform You of this as soon as possible and give You the option of reconfirming Your order at the correct price/description or cancelling it.
       
    • Please note that many of our Goods are handmade, unique, or utilize natural materials. As such, slight variations in color, size, shape, and texture may occur compared to the product images and descriptions. These variations are inherent characteristics of such items and are not considered defects.   
       
    • Images on the Website are for illustrative purposes. While we try to display colors accurately, we cannot guarantee that your Device’s display reflects the true color of the Goods.
    • All Goods are offered subject to availability.

  • Orders and Acceptance:

    • When You place an Order, You are making an offer to purchase Goods subject to these Terms.
    • We will send You an email acknowledging receipt of Your Order request. This email is confirmation that we have received your offer but does not constitute acceptance of Your Order.
    • A contract between You and Us for the purchase of Goods will be formed only when we send you a confirmation email stating that the Goods have been dispatched, or otherwise explicitly confirm acceptance.
    • We reserve the right to refuse or cancel any Order for any reason at any time prior to dispatch. Reasons may include, but are not limited to: Goods availability, errors in the description or price of the Goods, errors in Your Order, inability to obtain authorization for payment, suspicion of fraudulent activity, or shipping restrictions to your location. If we cancel Your order after payment has been taken, we will issue a full refund.

  • Pricing and Payment Terms:

    • Prices for Goods are subject to change without notice. The price applicable to your Order will be the price indicated on the Website at the time you complete your purchase, subject to correction for errors.
    • Our primary currency is USD. Prices may be displayed in other currencies for convenience, but final payment processing may occur in USD or as detailed on our Payment Methods page.
    • Accepted payment methods are listed on our Payment Methods page. By providing payment information, you warrant that you are authorized to use the chosen payment method.
    • You are responsible for any applicable taxes, customs duties, import fees, or other charges levied by your country or jurisdiction upon import. These charges are not included in the item price or shipping cost and are Your responsibility. Please check with your local customs office for details.
    • We reserve the right to correct any pricing errors on the Website.

  • Intellectual Property Rights:

    • The Service and all its original content (including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, product designs, and software) are the exclusive property of the Company or its content suppliers and are protected by Nepalese and international copyright, trademark, and other intellectual property laws.
       
    • You may not systematically extract or re-utilise parts of the content of the Service without Our express written consent. You may not use any data mining, robots, or similar data gathering and extraction tools to extract substantial parts of this Service for re-utilisation without Our express written consent. You may not create and/or publish your own database that features substantial parts of this Service (e.g., our prices and product listings) without Our express written consent.
       

  • User Accounts:

    • If You create an account on our Website, You are responsible for maintaining the confidentiality of Your account login information (username and password) and for restricting access to Your Device. You agree to accept responsibility for all activities that occur under Your account. Please notify Us immediately if you suspect any unauthorized use of your account.
       

  • User Conduct:

    • You agree not to misuse the Service. You will not commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, logic bomb or any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material (“spam”); or attempt to affect the performance or functionality of any computer facilities accessed through this Website. Breaching this provision would constitute a criminal offense under applicable laws. Upon termination, Your right to use the Service will cease immediately. If you have placed Orders that have not yet been fulfilled, termination may result in the cancellation of those Orders, subject to refund where applicable according to our policies.

6. Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service for the Goods related to the claim, or 100 USD if You haven’t purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

The laws of Nepal, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service, including any purchases made. Your use of the Service may also be subject to other local, state, national, or international laws relevant to your location regarding import or consumer rights.

9. Disputes Resolution

If You have any concern or dispute about the Service or a purchase, You agree to first try to resolve the dispute informally by contacting the Company. We are committed to working with you to reach a fair resolution. If a resolution cannot be reached informally, disputes may be subject to the jurisdiction of the courts of Nepal, unless otherwise mandated by applicable consumer protection laws in your jurisdiction.

10. For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. These Terms do not affect your statutory rights as a consumer under EU law.

11. United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

12. Severability and Waiver

  • Severability: If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect. 
     
  • Waiver: Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

13. Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute or ambiguity.

14. Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material (which will be determined at Our sole discretion), We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect, likely via email or a prominent notice on our Website.
